Privacy Policy
1. Controller
The controller within the meaning of the General Data Protection Regulation (GDPR) is:
MAGNETIQ YOU LLC
1209 Mountain Road PL NE, Ste R
Albuquerque, NM 87110
USA
Email: hello@magnetiqyou.com
2. General information on data processing
We only process personal data of our users to the extent necessary to provide a functional website and our content and services, or where you have given your consent. The legal bases are in particular Art. 6 (1) GDPR (lit. a consent, lit. b contract, lit. f legitimate interest).
3. Hosting and server log files
Our website is delivered via the global network of Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA (Cloudflare Workers / content delivery network). Cloudflare serves the content from servers as close as possible to the user's location - within the EU usually from data centres in the EU. When you access the website, data transmitted by your browser is automatically recorded in server log files: IP address, date and time, page/file accessed, referrer URL, browser and operating system. Cloudflare also uses this data to fend off attacks and secure operations.
Processing takes place to ensure stable, secure and fast operation (Art. 6 (1) lit. f GDPR). A data processing agreement (Art. 28 GDPR) is in place with Cloudflare. Cloudflare is certified under the EU-U.S. Data Privacy Framework; data transfers to the USA are therefore based on a recognised adequacy decision (see section 11). Log files are stored only for a short period.

4. Contact (form / email)
If you contact us via contact form or email, we process the data you provide (e.g. name, email address, message) in order to handle your enquiry.
Legal basis: Art. 6 (1) lit. b GDPR (pre-contractual measures/contract) or lit. f GDPR (legitimate interest in responding). The data is deleted once your enquiry has been dealt with and no statutory retention obligations apply.
5. Newsletter
Our newsletter is sent via our platform HighLevel (HighLevel, Inc., USA); in this respect the information in section 3 applies (data processing agreement, EU-U.S. Data Privacy Framework). You can unsubscribe from the newsletter at any time via the unsubscribe link or by sending us a message. Withdrawal does not affect the lawfulness of processing carried out up to that point.
6. Shop, orders and payment processing
When you place an order, we process the data required to fulfil the contract (e.g. name, billing/delivery address, email, services ordered). Legal basis: Art. 6 (1) lit. b GDPR. Retention obligations under tax and commercial law remain unaffected.
Payments are processed via Stripe and PayPal. Payment data is transmitted directly to the respective provider; we do not store complete payment data ourselves.
Stripe: Stripe Payments Europe, Ltd. (for users in the EEA), The One Building, 1 Grand Canal Street Lower, Dublin 2, Ireland. Privacy: https://stripe.com/privacy
PayPal: PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. Privacy: https://www.paypal.com/legalhub/privacy-full
The legal basis for the transfer is Art. 6 (1) lit. b GDPR (performance of contract).
7. Web analytics
To analyse website usage we use the analytics and tracking functions integrated in the HighLevel platform. Usage data (e.g. pages visited, approximate location, device/browser) may be processed in the course of this.
Legal basis: your consent (Art. 6 (1) lit. a GDPR), given via our cookie/consent banner. You can withdraw your consent at any time with effect for the future.
8. Social media plugins / pixel
We use the Meta Pixel (Facebook Pixel). It allows user behaviour after clicking on an ad to be recorded for marketing and reach analysis and transmitted to Meta. This may also involve a transfer to the USA.
Provider: Meta Platforms Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland (parent company Meta Platforms, Inc., USA). Meta is certified under the EU-U.S. Data Privacy Framework. Privacy: https://www.facebook.com/privacy/policy

9. Reviews (ProvenExpert)
On our website we display our current overall rating and the number of customer reviews from the review platform ProvenExpert. These values are retrieved directly from the ProvenExpert server when the page is loaded and are updated automatically. In the process, your IP address and technical information about your browser and device are transmitted to ProvenExpert; no cookies are set for this. Customer testimonials that we reproduce as text on the website come from our ProvenExpert profile and are published with the customers' consent.
Provider: Expert Systems AG, Quedlinburger Str. 1, 10589 Berlin, Germany. Privacy: https://www.provenexpert.com/en-us/privacy-policy/
Legal basis: our legitimate interest in a transparent and trustworthy presentation of our services (Art. 6 (1) lit. f GDPR).
10. Free downloads and email impulses
On our Downloads page (in German) we offer free content, such as a meditation audio file. To receive it, you enter your name, your email address and - optionally - your phone number into a form. We use this data to send you the content you asked for and, afterwards, further information and offers around our topics by email (newsletter). You can unsubscribe at any time, for example via the unsubscribe link in every email or by sending us a short message.
The form is provided, processed and stored by our service provider HighLevel. The form is only loaded once you have explicitly requested it with a click. Before that, no connection to HighLevel is made and no data is transferred. When the form is loaded and submitted, your IP address and technical information about your browser and device are transmitted to HighLevel.

EU representative: Rickert Rechtsanwaltsgesellschaft mbH - HighLevel, LLC -, Colmantstraße 15, 53115 Bonn, Germany. Privacy policy: https://www.gohighlevel.com/privacy-policy
HighLevel is certified under the EU-U.S. Data Privacy Framework; the transfer to the USA is based on this (Art. 45 GDPR). A data processing agreement is in place with HighLevel.
To protect against automated submissions, the form also uses the Turnstile service by Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA. Privacy policy: https://www.cloudflare.com/privacypolicy/
The legal basis for loading the form and for sending the emails is your consent (Art. 6 (1) (a) GDPR, Sec. 7 (2) no. 3 UWG), which you can withdraw at any time with effect for the future. We store your data until you unsubscribe or object to the processing.
11. Cookies and consent management
We use technically necessary cookies (legal basis: Section 25 (2) TDDDG, Art. 6 (1) lit. f GDPR) and - only with your consent - cookies and technologies for analytics and marketing (Section 25 (1) TDDDG, Art. 6 (1) lit. a GDPR). You manage and withdraw your consent via our consent banner.
12. Data transfers to third countries (USA)
Some of the services used (including hosting, possibly analytics, payment, social media) as well as the controller itself are located outside the EU/EEA, in particular in the USA. Transfers only take place where an adequate level of data protection is ensured, for example through:
- certification of the recipient under the EU-US Data Privacy Framework, or
- the conclusion of EU standard contractual clauses (Art. 46 GDPR), or
- your explicit consent (Art. 49 (1) lit. a GDPR).
It cannot be ruled out that authorities in the third country may access transferred data.
13. Your rights
You have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and the right to object to processing based on legitimate interests (Art. 21 GDPR). You may withdraw any consent given at any time with effect for the future.
To exercise your rights, simply send a message to: hello@magnetiqyou.com
14. Right to lodge a complaint
You have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU member state of your habitual residence or of the alleged infringement.
15. SSL/TLS encryption
For security reasons this website uses SSL/TLS encryption. You can recognise an encrypted connection by the “https://” prefix and the padlock symbol in your browser bar.
